These Terms of Service (the “Terms of Service”) are a legal agreement between you and Thea Career Inc (“Thea Career,” “we,” “us,” or “our”). These Terms of Service specify the terms under which you may access and use our website located at theacareer.com (the “Site”), our mobile application (the “App”), and our online learning platform (the “Platform”) (collectively the “Services”).

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING AND USING THE SERVICES OR ANY PORTION THEREOF. BY USING ANY OF THE SERVICES, CLICKING “I AGREE,” OR OTHERWISE MANIFESTING YOUR ASSENT TO THESE TERMS OF SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY (TOGETHER, THE “AGREEMENT”), WHICH IS HEREBY INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

The sections below titled “Binding Arbitration” and “Class Action Waiver” contain a binding arbitration agreement and waiver of class actions. They affect your legal rights.

If you accept this Agreement on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity. In that case, “you” and “your” will refer to that entity.

1. OUR SERVICES AND USERS

The Services provide an online platform where students can access educational content, training modules, quizzes, and assignments across various professional development courses (the “Courses”).

We have several types of users:

Visitors. Visitors to our Site are people who do not register for an account but may view publicly available content.
Registered Users. In order to enroll in Courses or access the Platform, you must register for an account. Each registered user (“User”) must provide accurate and current information when creating an account and is responsible for maintaining the confidentiality of their login credentials.

You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or suspected unauthorized use of your account.

2. RESTRICTIONS

The Services are available only to individuals aged 18 or older. If you are under the age of majority in your jurisdiction, you must review this Agreement with your parent or guardian.
We reserve the right, at our discretion, to deny or suspend access to the Services, including by closing accounts without prior notice.

3. USER DATA AND LICENSES

“User Data” means any information you provide to the Platform, including personal details, assignments, quiz responses, or uploaded files.
“Usage Data” refers to data we collect about how you interact with the Platform (e.g., logins, progress tracking, time spent on activities).

By submitting User Data, you grant Thea Career a non-exclusive, worldwide, royalty-free license to process and use the data for the purposes of operating the Services.

We may use aggregated, anonymized data (“Aggregate Data”) for analytics, improvements, and research. Aggregate Data does not identify individual Users.

4. PAYMENTS AND SUBSCRIPTIONS

Some Courses may require payment of fees (“Course Fees”) displayed at checkout. Payments are processed through third-party providers (e.g., Stripe, PayPal).

You agree to provide accurate billing information.
Subscriptions may be billed monthly or annually.
Fees are non-refundable except as required by law or explicitly stated in writing by Thea Career.
You are responsible for canceling subscriptions prior to renewal.

5. FREE TRIALS

From time to time, Thea Career may offer Free Trials. Free Trials are subject to these Terms of Service. We reserve the right to modify or discontinue Free Trials at our discretion.

6. INTELLECTUAL PROPERTY

All content, software, text, graphics, videos, quizzes, and other materials on the Services (“Content”) are owned by Thea Career Inc or our licensors.

You are granted a limited, non-transferable, non-exclusive license to access the Services for personal educational purposes only. You may not copy, distribute, modify, or exploit any Content without our written permission.

All trademarks, service marks, and logos used on the Services are the property of Thea Career or third parties.

7. USER CONDUCT

When using the Services, you agree not to:

Upload or share unlawful, defamatory, obscene, or infringing content.
Misrepresent your identity or impersonate another person.
Attempt to gain unauthorized access to the Platform.
Interfere with the functionality of the Services.
Share your account with others.

8. NO WARRANTIES; LIMITATION OF LIABILITY

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Thea Career disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or availability.

To the fullest extent permitted by law, Thea Career shall not be liable for indirect, incidental, or consequential damages. Direct damages shall be limited to one hundred U.S. dollars (US $100).

9. COMPLIANCE WITH LAWS

You are responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.

10. DISPUTE RESOLUTION: BINDING ARBITRATION

In the event of a dispute between you and Thea Career, the matter shall be resolved by binding arbitration under the Federal Arbitration Act (FAA). You waive the right to bring claims in court or to have a jury trial, except where small claims court applies.

11. CLASS ACTION WAIVER

You agree that disputes must be brought in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

12. EQUITABLE RELIEF

Thea Career may seek injunctive or equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

13. EXTERNAL SITES

Our Services may link to third-party websites. We are not responsible for third-party content and you access such sites at your own risk.

14. CHANGES TO TERMS

These Terms of Service are effective as of the “Last Updated” date. We may change these Terms at any time, and updates will be posted on the Site. Continued use of the Services constitutes acceptance of changes.

15. GENERAL

This Agreement constitutes the entire agreement between you and Thea Career. If any provision is found unenforceable, the remainder shall remain in effect.
